On Tuesday, the U.S. Supreme Court declined to hear a
student's appeal of his school district's ban on wearing a T-shirt in class
that reads, "There are only two genders."
Justices Clarence Thomas and Samuel Alito, two of the
court's leading conservatives, suggested they would review the student's case,
arguing that lower courts were distorting the First Amendment, The Hill
reported.
"If a school sees fit to instruct students of a certain
age on a social issue such as LGBTQ+ rights or gender identity, then it must
tolerate dissenting student expression on those issues," Alito wrote, joined
by Thomas.
