Portions of Title VII's controversial protections against sex discrimination in employment were struck down

 


A federal judge has struck down portions of former President Joe Biden's Equal Employment Opportunity Commission guidance that established that Title VII's protections against sex-based employment discrimination also included discrimination based on sexual orientation and gender identity.

Judge Matthew J. Kacsmaryk of the U.S. District Court for the Northwest District of Texas, a Trump appointee, stated in his decision that the guidance's language stating that "sex" in Title VII included sexual orientation and gender identity is "contrary to law," Fox News reported.

"Sex discrimination under Title VII includes employment discrimination based on sexual orientation or gender identity," the Biden-era guidance stated. "Accordingly, sex-based harassment includes harassment based on sexual orientation or gender identity, including how that identity is expressed."
